1. Who we are

The Real Estate Genie, Home Listing Genie, and Home Buying Genie services, websites, and mobile apps (the "Services") are provided by Christopher L. Smith, P.A. d/b/a Southern Realty Associates ("we," "us"), a licensed Florida real estate brokerage. By using the Services, you agree to these Terms.

2. The Services

We provide real estate brokerage services, including a flat-fee and tiered listing service, buyer representation, guided tools for preparing real estate documents, and related technology. The Services help you prepare and submit real estate listings and offers; a licensed real estate professional is involved in the brokerage services we provide.

3. Eligibility and accounts

You must be at least 18 and able to enter a binding contract. You agree to provide accurate information and to keep your account secure. Certain actions (such as signing agreements) require identity verification.

4. Fees and payments

Fees for the Services are disclosed before you are charged and are payable through our payment processor. Listing fees, buyer-side fees, and any rebates or credits are described at the point of sale and in the applicable agreement. Promotional and launch pricing may apply by market and time period. Unless stated otherwise or required by law, fees are non-refundable once the service has been performed.

5. Listings, offers, and MLS

Information you provide about a property is your representation and is relied upon by us and by buyers. You authorize us to prepare and submit your listing to the applicable Multiple Listing Service and to the distribution channels you select. MLS rules govern listing data; you agree to comply with them. Marketing pages and materials we create about your property are our and your first-party content, separate from MLS data.

6. Agreements and electronic signatures

You consent to transact electronically and to sign documents using our electronic signature provider. Real estate agreements (such as listing agreements and buyer-broker agreements) are binding legal contracts; review them carefully.

7. Your responsibilities

You agree not to misuse the Services, submit false information, infringe others' rights, or use the Services for unlawful purposes.

8. Third-party services

The Services rely on third parties (payment, identity verification, e-signature, storage, mapping, and social platforms). Your use of those features is also subject to their terms.

9. Disclaimers

The Services are provided "as is." Property information is provided by sellers and deemed reliable but not guaranteed; you should independently verify it. We do not provide legal, tax, or financial advice.

10. Limitation of liability

To the maximum extent permitted by law, our liability arising from the Services is limited as set out here, and we are not liable for indirect or consequential damages.

11. Fair Housing

We comply with Fair Housing laws and provide equal professional service to all.

12. Changes and termination

We may modify the Services or these Terms, and may suspend access for violations. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of the State of Florida.
